GENERAL RELEASE AND WAIVER OF LIABILITY

GUAD HAUS LLC

In consideration of being permitted to enter upon and/or participate in any event, activity, rental, meeting, workshop, gathering, or use of the premises operated by Guad Haus LLC (“Company”) located in Austin, Texas (the “Premises”), the undersigned hereby acknowledges, agrees, and represents as follows:

ASSUMPTION OF RISK
The undersigned acknowledges that entry upon the Premises and participation in any activity conducted therein involves inherent risks, including but not limited to bodily injury, illness, death, property damage, slips and falls, use of furniture or equipment, interaction with other individuals, consumption of food or beverages (including alcoholic beverages), and participation in creative, wellness, physical, or social activities. The undersigned voluntarily assumes full responsibility for any and all risks associated with entry upon the Premises and participation in any activity, whether such risks are known or unknown.

RELEASE OF LIABILITY
The undersigned hereby releases, waives, discharges, and covenants not to sue Guad Haus LLC, including its members, managers, owners, employees, contractors, agents, representatives, renters, vendors, and event hosts (collectively, the “Released Parties”), from any and all claims, demands, causes of action, damages, losses, liabilities, or expenses of any kind arising out of or related to entry upon the Premises or participation in any activity conducted thereon, whether hosted by Guad Haus LLC or by any third party. This release includes, without limitation, claims arising from the negligence of the Released Parties to the fullest extent permitted under the laws of the State of Texas, whether arising in contract, tort or otherwise. 

PRIVATE RENTALS AND THIRD-PARTY EVENTS
The undersigned acknowledges that the Premises may be rented to third parties for private events and that activities conducted on the Premises may be organized or facilitated by individuals or entities other than Guad Haus LLC. The undersigned agrees that Guad Haus LLC shall not be responsible for the acts, omissions, services, food, beverages, advice, or conduct of any third-party renter, vendor, or event host.

INDEMNIFICATION
The undersigned agrees to indemnify, defend, and hold harmless the Released Parties from and against any and all claims, damages, liabilities, costs, and expenses, including reasonable attorney’s fees, arising out of or related to the undersigned’s actions while on the Premises.

ALCOHOL
If alcoholic beverages are present or consumed on the Premises, the undersigned represents that they are at least twenty-one (21) years of age and assume full responsibility for their consumption. Guad Haus LLC reserves the right to refuse service to or remove any individual who appears intoxicated or is engaging in unsafe or disruptive behavior. The undersigned acknowledges that the Released Parties shall not be liable for any injury, damage, or loss resulting from alcohol consumption.

PERSONAL PROPERTY
The undersigned acknowledges that Guad Haus LLC is not responsible for loss, theft, or damage to personal property brought onto the Premises.

MEDIA RELEASE
The undersigned grants Guad Haus LLC the right to photograph, video record, and otherwise capture their image, likeness, and voice while on the Premises and to use such materials for promotional, marketing, or editorial purposes without compensation.

MINORS
If the undersigned is executing this Agreement on behalf of a minor, the undersigned represents that they are the parent or legal guardian of such minor and agree to be bound by the terms of this Agreement on behalf of the minor participant.

GOVERNING LAW; SEVERABILITY
This Agreement shall be governed by and construed in accordance with the laws of the State of Texas. If any provision of this Agreement is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

ACKNOWLEDGMENT
THE UNDERSIGNED HAS READ THIS AGREEMENT IN ITS ENTIRETY, FULLY UNDERSTANDS ITS TERMS, AND VOLUNTARILY AGREES TO BE LEGALLY BOUND HEREBY. THE UNDERSIGNED UNDERSTANDS THAT THIS DOCUMENT INCLUDES A RELEASE OF LIABILITY AND A WAIVER OF CERTAIN LEGAL RIGHTS.
